Streetwise Franchise Limited is the franchisor of the Streetwise Coffee brand and system. Apart from a few company owned Streetwise Coffee outlets, all Streetwise Coffee outlets in New Zealand are independently owned and operated by our team of awesome franchisees (Franchisees) who are dedicated to producing amazing coffees and providing exceptional and friendly service. 

This privacy policy is for Streetwise Franchise Limited and the expressions “we”, “us” and “our” refer to Streetwise Franchise Limited. 

We respect your privacy and are committed to the protection of it. This privacy policy applies to all of your Personal Information that we obtain about you whether that is via your use of our website, our mobile purchasing app, your involvement in promotions and competitions, via social media (e.g. Facebook and Instagram) and otherwise from your interactions with us or any of our Franchisees.

If you are under 16 years old you should have the consent of your parent or legal guardian before using this website or otherwise sharing any of your Personal Information with us.

Personal Information

In this policy, Personal Information is information pertaining to a natural person as that expression is defined and used in the Privacy Act 2020 (Privacy Act). This Personal Information may include, amongst other things:

  • Contact information (like your email address, physical address, postal address and contact telephone numbers). 

  • Payment information (like your credit, debit or eftpos card details)

  • Any additional information that you provide to us directly or indirectly through our websites, mobile purchasing app, representatives, use of services or otherwise.

When you interact with us including (without limitation) creating an account on our website or on our mobile purchasing app, interacting with us via social media, participating in competitions and/or promotions, or when you otherwise place an order with us we are able to access any information you provided, including but not limited to your:

  2. Email address.

  3. Postal/Residential Address.

  4. Phone number.

  5. Payment details.

  6. Social media handles.

  7. Photographs and videos that identify you.

Collection Of Personal Information

We will collect and retain all your Personal Information in accordance with the Privacy Act (as may be modified by these terms, to the maximum extent permitted by law).

Some of the ways that we collect Personal Information, is when you:

  1. Order/purchase products and/or services from us.
    Access and use our website and mobile purchasing app including your registration details and information relating to your use of the website and our mobile purchasing app, such as the products you view, or the search queries you input.

  2. Access and interact with our social media platforms, such as Facebook and Instagram.

  3. Call, email or otherwise interact with us or our representatives. 

  4. Enter promotions and competitions that we run or facilitate.

  5. Apply for a job or to become a Streetwise Coffee franchisee.

  6. Provide other information to us including feedback, complaints and responses to our surveys and promotions.

We may also collect Personal Information from other sources, including but not limited to:

  1. Our Franchisees, who you may deal with and who are independent of us.

  2. Social media sites, including (but not limited to) Facebook, Twitter, Instagram, YouTube, Pinterest and Snapchat. The information we receive from these social media sites will be subject to the social media site’s policies.

  3. Companies that provide Personal Information to supplement what we already know about you, including data aggregators. 

When you visit and navigate our website, mobile purchasing app and social media accounts, we may use automated technology (such as cookies and other usage monitoring software) to collect and store certain information about your visit, including without limitation:

  1. Details about the devices used to access our website and mobile purchasing app(such as location, IP address, domain name, browser information, device information and operating system information).

  2. Details about your interaction with our website and mobile purchasing app (such as date, length of visit, location activity (if you have allowed these), referral activity, emails/messages you may have opened or sent and the pages you visit).

  3. Usage information (such as the number and frequency of visitors to our website).

If We Are Not Able To Collect Personal Information

We may use your Personal Information for the following purposes, and you agree to us disclosing your Personal Information for these purposes:

To send you marketing and promotional materials and links that we consider are relevant to you (such as offers that we think you would be interested in, news and information about the Streetwise Coffee network and general marketing purposes to encourage and promote the use of our website and mobile purchasing app).

  2. To contact you regarding your use of our website and mobile purchasing app including sending you notifications, alerts and information relating to your use of our website and mobile purchasing app and otherwise assisting you with your use of our website and mobile purchasing app.

  3. To send to our marketing advisors to assist us in developing marketing and promotional campaigns for the Streetwise Coffee network.

  4. For business operations and activities (including marketing and promotional activity) of our Franchisees, and for the management and support of our Franchisees in our role as franchisor.

  5. For processing any employee or Franchisee applications. 

  6. To pass on to our third-party partners (such as MOBI who owns and operates our mobile purchasing app) to enable transactions to be processed.

  7. To pass on to our developers and other professional advisors as we consider necessary to enable us to improve our website and mobile purchasing app and to otherwise protect our interests.

  8. To share with entities that we are required or permitted by law to disclose your information to.

  9. To share anonymised data, for example, usage and transactional data with third parties for marketing and performance insights. 

  10. To third parties notified to you at the time of collecting your Personal Information or other such persons with your express consent.

We may also disclose information about you or your use of the website or our services without your prior permission if, in good faith, we consider that such action is necessary to:

  1. Comply with our legal obligations.

  2. Sell our business, franchises and/or assets, in which case we will disclose your Personal Information to the prospective buyer of such business or assets.

  3. Protect the rights, property and safety of the Streetwise Coffee network (including us, our Franchisees, our customers and others).  

  4. Detect and protect ourselves against fraud or any technical or security vulnerabilities.

Where we provide your Personal Information to our third-party providers (such as, for example, our third-party partners or our developers) or we receive your Personal information from such third parties, you agree and consent to:

  1. The exchange of your Personal Information in that way.

  2. To those providers individual privacy policies (as updated from time to time).

  1. See any Franchisee or third-party providers privacy policy, please contact us through the Contact Us section of the website and we will procure that they are provided to you.

  2. Update any of your Personal Information that we hold, you may do so via your account settings on our website and mobile purchasing app.

  3. Opt out of receiving our promotions and other communications, you may do so by emailing your request to marketing@streetwisecoffee.co.nz.

Security and Storage of Personal Information

When we have access to and hold your Personal Information, we take reasonable steps to keep such information safe and secure. We implement a number of technical and administrative security measures to protect your Personal Information from unauthorised access, misuse, loss, modification and/or disclosure. 

The information that we collect from or about you is processed in New Zealand and stored on secured servers such as Google and SquareSpace. We will keep your Personal Information for as long as we reasonably require in accordance with this policy, unless we are required by law to hold it for any longer or shorter duration. 

Your Personal Information will not be shared, sold, rented or disclosed other than as described in this policy or as permitted by law.

Franchisees

Most Streetwise Coffee outlets are individually owned and operated by Franchisees who are independent from us. We and our Franchisees may share Personal Information collected from you with each other and each use that information for the purpose it was collected for, or any other purpose as set out in this policy to enable us and our Franchisees to provide products and services to you and to conduct our business generally. You agree to this exchange of your Personal Information. 

Please note that where you interact with any of our Franchisees via their social media accounts (or otherwise), you will be doing so directly with them and the terms of their privacy policies will apply. We are not responsible for the policies and practices of our Franchisees.

Third Party Platforms & Links

Our mobile purchasing app is owned and operated by MOBI.

You agree that when you use our mobile purchasing app to place orders, you must first be satisfied with MOBI’s privacy policy. This is located at https://www.mobihq.com/privacy-policy. We do not have control over such policy.

Each third-party platform such as iOS, Android and social media platforms (for example, Facebook and Instagram) will have their own permissions systems for obtaining your consent to the use of your Personal Information that you share via those platforms. You can learn more about these policies and sometimes make changes to your settings directly through those third-party platforms.

Sometimes we may have links on our website, mobile purchasing app, social media accounts and communications to you. If you visit a linked site, please make sure you review their privacy policies first. We are not responsible for the policies and practices of other platforms (including that of our third-party partners).

In addition, you agree that we can collect additional Personal Information about you by using cookies, beacons, pixels and other similar means. This will let us:
